Boat Concierge Co. LLC is a boat charter booking service dedicated to helping guests (“you,” “guest,” or “client”) get out on the water by connecting them with independent, vetted boat charter operators and making the booking process simple from first inquiry to departure.

1. Contract

These Terms and Conditions (“Agreement”) form a legally binding contract between you and Boat Concierge Co. LLC. By requesting or confirming a boat charter booking, submitting information, or using our services, you acknowledge that you have read, understood, and agree to these Terms.

This Agreement incorporates:

  • All communications, proposals, and correspondence between you and us
  • The terms and policies of third-party charter operators (“Operators”)
  • Any waivers or notices contained herein

If you are booking on behalf of others (family, couple, or group), you confirm you are authorized to act for all guests in your party and agree to share these Terms with them.

You represent and warrant that you are of legal age, can create binding obligations, are authorized to act for those you represent, and that all information you provide is accurate.

2. Scope of Services & Agency Relationship

Boat Concierge acts solely as an independent booking agent in arranging boat charters and related on-water experiences (“Charter Services”) provided by independent third-party operators (“Operators”).

We do not own, operate, control, captain, crew, or manage any vessel, and we do not provide the charter services themselves. Each Operator is fully responsible for its own vessels, crew, equipment, safety practices, operations, terms, and policies.

By booking through Boat Concierge, you agree to abide by all applicable Operator terms, including cancellation, refund, safety, and liability provisions. We are not responsible for:

  • Acts, errors, or omissions of any Operator
  • The condition, seaworthiness, or safety of any vessel or equipment
  • Operator insolvency, delays, or service interruptions
  • Any event beyond our reasonable control

Your interaction with any Operator, and your participation in any charter, is at your own risk.

3. Booking & Payment

We provide assistance in connecting you with vetted boat charter operators and managing booking logistics.

When you confirm your charter, you authorize Boat Concierge to coordinate with the Operator on your behalf and to provide the details necessary to secure your booking. Payments are made directly to the Operator whenever possible, and all bookings are subject to the Operator’s payment terms and conditions.

If an Operator requires a deposit or full payment, you will be notified in advance and provided with secure payment instructions or links.

4. Price & Rate Changes

All charter prices and rates are based on information provided by Operators and are subject to change until payment is confirmed. Prices may vary due to fuel costs, taxes, surcharges, gratuities, seasonal demand, or Operator updates.

Boat Concierge has no control over price adjustments made by Operators and is not liable for differences arising after a booking is confirmed.

5. Changes, Cancellations & Refunds

All changes, cancellations, and refund requests are governed by the policies of the applicable Operator. Boat Concierge does not charge any service or administrative fees for assisting with modifications or cancellations.

If an Operator issues a credit, voucher, or refund, that refund will be processed in accordance with the Operator’s specific terms. We will assist you in communicating with the Operator to facilitate the process but cannot guarantee reimbursement or credits.

6. Force Majeure

Boat Concierge is not responsible for losses or expenses due to events beyond our reasonable control (“Force Majeure”), including but not limited to: weather, sea or wind conditions, storms, natural disasters, strikes, civil unrest, pandemics, governmental or port authority actions, mechanical failure, or Operator insolvency.

Charters are subject to weather and safe operating conditions. Decisions to delay, modify, or cancel a charter for safety reasons rest solely with the Operator and its captain. Refunds or rebooking options in such circumstances are subject to Operator discretion and availability.

7. Travel Protection Insurance

Boat Concierge strongly recommends that all guests purchase comprehensive travel protection insurance.

Travel insurance may cover trip cancellation, delays, medical emergencies, or Operator defaults. We are not licensed insurance producers and cannot guarantee coverage or claim outcomes.

If you choose not to purchase insurance, you assume full responsibility for any losses that would otherwise be covered.

8. Guest Documentation & Responsibilities

You are solely responsible for providing accurate guest details and ensuring that all names match government-issued identification where required by the Operator.

It is your responsibility to secure and comply with any documentation, age requirements, or other conditions imposed by the Operator or by law for participation in a charter. Some Operators may require valid identification at check-in or impose minimum age requirements.

Boat Concierge is not liable for denied boarding, refused service, or additional expenses resulting from missing or inaccurate documentation, late arrival, or failure to meet an Operator’s requirements.

9. Credit Card Authorization & Chargebacks

By submitting payment through any Operator or Boat Concierge platform, you authorize valid charges in accordance with the Operator’s terms.

You agree to contact us first to resolve any billing or service concerns before initiating a chargeback with your financial institution.

Improper chargebacks include (but are not limited to):

  • Disputes for non-refundable reservations or services you agreed to
  • Disputes resulting from Operator policies or cancellations
  • Attempts to recover funds for unpurchased travel insurance

We reserve the right to dispute improper chargebacks and recover associated costs.

10. Limitation of Liability

To the fullest extent permitted by law, Boat Concierge’s total liability for any claim shall not exceed the amount of commission or compensation directly received by us for the booking in question.

We are not liable for indirect, incidental, consequential, or punitive damages, or for any acts, errors, or omissions by any third-party Operator.

11. Assumption of Risk & Waiver

Boating and on-water activities involve inherent risks, including but not limited to: rough water and weather, vessel motion, slips and falls, swimming and water sports, marine life, equipment failure, transportation delays, illness, injury, or other unforeseen events.

By engaging our services and participating in any charter, you voluntarily assume all such risks and release Boat Concierge, its owners, agents, and employees from any liability arising from participation in any charter or related arrangements, except in cases of gross negligence or willful misconduct on our part.

12. Indemnification

You agree to indemnify and hold harmless Boat Concierge and its representatives from any claims, damages, or losses (including reasonable attorney’s fees) arising from:

  • Your breach of this Agreement
  • Your negligence or misconduct
  • Third-party claims related to your conduct during a charter

13. Your Conduct

All guests are expected to act respectfully and responsibly while aboard a vessel or participating in booked charter services, and to follow the instructions of the captain and crew at all times.

Operators reserve the right to refuse boarding or service to, or to remove, any guest who disrupts operations, exceeds the vessel’s passenger capacity, endangers themselves or others, is impaired by alcohol or other substances, or violates local laws or Operator rules — without refund.

You are responsible for any damage or loss caused by you or your party and agree to pay such charges directly to the affected Operator.

14. Health, Disabilities & Accessibility

Please inform us of any medical conditions, mobility limitations, pregnancy, or accessibility needs prior to booking so we can communicate them to the Operator. Boating can involve significant motion, uneven surfaces, and limited access to medical care.

While we make every effort to accommodate requests, Boat Concierge cannot guarantee that specific accommodations or accessibility features will be available on any given vessel.

15. Intellectual Property & Media Use

All materials created or provided by Boat Concierge — including recommendations, guides, and digital content — are the intellectual property of Boat Concierge Co. LLC and may not be reproduced or distributed without written consent.

By sharing testimonials, photos, or tagging our business on social media, you grant Boat Concierge permission to use such content for marketing purposes unless you request removal in writing.

16. Website Terms of Use & Privacy

By using our website, you agree not to engage in unlawful, fraudulent, or disruptive activity. All website content is provided “as is,” and Boat Concierge makes no warranties regarding accuracy or third-party links.

Privacy: We collect and store only the information necessary to arrange and manage your boat charter booking. Personal data is kept confidential, securely stored, and never sold. You may request updates or deletion of your personal data by contacting info@boatconcierge.com.

We comply with applicable data protection laws, including the CCPA and, if applicable, the GDPR. Please review our Privacy Policy for details.

17. Affiliate Disclosure

Boat Concierge may recommend or facilitate bookings through affiliate or commissionable relationships, including but not limited to:

  • Charter and activity booking platforms (e.g., FareHarbor, Viator)
  • Independent boat charter operators and captains
  • Travel insurance providers and transportation partners

We may receive commissions at no additional cost to you. Our affiliate partnerships do not influence the integrity of our recommendations, which are based on experience and service quality. By booking through our links or referrals, you acknowledge and consent to these affiliate relationships.

18. Dispute Resolution, Governing Law & Venue

We aim to resolve all issues amicably. If a dispute cannot be resolved informally, both parties agree to binding arbitration in the State of South Carolina, pursuant to the applicable rules of South Carolina.

This Agreement is governed by the laws of the State of South Carolina, and any legal proceedings shall be brought exclusively in the state or federal courts located in South Carolina.

19. Severability & Modifications

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in full force and effect.

Boat Concierge may update these Terms at any time. The most recent version posted on our website is considered binding.

Acknowledgment

By booking a boat charter, submitting information, or using our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, including our Privacy Policy and Affiliate Disclosure.
